The Administration of Estates Act 66/1965 applies where the deceased died on or after 2nd October 1967. Occasionally the estate of a person who died before then is re-opened in which case it is necessary to refer to the previous Act 24/1913. All estates in which, in the Republic of South Africa, there are assets or there is a Will, or a document purporting to be a Will, must be reported in South Africa. The estate is reported to the appropriate office of the Master of the High Court who appoints an executor. The executor takes the assets under his control and pays the liabilities. He submits a liquidation and distribution account to the Master showing the assets and the liabilities, what the balance for distribution is and who gets the balance. Once the Master has approved the liquidation and distribution account the executor distributes the balance and lodges proof of distribution with the Master who then issues a filing certificate. This sounds fairly straightforward but in practice all sorts of complications can arise.
