What is set out in the section on basic concepts is just that –very basic. The principles pertaining to each type of fund, and the different benefits payable are a lot more complex in reality. In addition, in view of the overlapping fields and complaint jurisdictions in the financial services sector, we also handle complaints relating to financial services providers before the FAIS Ombud and complaints before the Ombud for Long Term Insurance. It is significant to note here that the concept of a “Super-Ombud” has once again been tabled. This proposal, involving a combined complaints forum for all the existing statutory and voluntary dispute resolution structures, has been on the regulator’s agenda for many years now. The primary motivation for such a combination tribunal is to counteract the confusion and opportunity for abuse (by arbitrage, or forum-shopping) created by the existence of so many different tribunals. At the moment the Super-Omud is still a goal, not a reality. We presently live in a regulatory environment strewn with overlapping forums and jurisdictions in the financial arena.
